Delta-9 THC is the common THC molecule found naturally in the cannabis plant. Extracted Delta-9 is then used in products like gummies and seltzers. According to the 2018 Farm Act, hemp is classified as cannabis containing less than 0.3% THC, while marijuana is classified as cannabis containing more than 0.3% THC. While marijuana has been legalized for medicinal and/or recreational use in certain states, THC derived from hemp is legal in almost every state if it falls under the 0.3% threshold by dry weight in a finished product. Hemp and marijuana are the same species—cannabis; their only difference is a legal distinction.
